Coronavirus: Self-Isolation Regulations

The Self-Isolation Regulations came into force on 28 September 2020 and apply to:Only applies to England.The Regulations are divided into three parts.

Part 1 (R. 1-5) imposes the obligation to self-isolate in respect of persons who test positive for coronavirus and their contacts.

Part 2 (R. 6-9) prohibits employers from making employees, including agency workers, who are required to isolate, attend any place for purposes related to their employment other than the place where they are required to self-isolate. Employees who are isolated must also notify their employer of the need to isolate.

Part 3 provides for enforcement and prosecution for breaches of the Regulations. It also explains what can be done with the information that individuals are required to provide under the Regulations.

This guidance is a summary of the main provisions of the Regulations and incorporates only the main amendments introduced by other Regulations. This guidance is not all-inclusive, nor does it reflect all amendments introduced by the amending Regulations. Key Amendments

The Regulations were further amended by The Health Protection (Coronavirus, Restrictions) (Steps) (England) Regulations 2021 of 29 March 2021, which clarified the territorial application of the Regulations and created new exemptions from the requirement to self-isolate or remain in self-isolation, including participants in a continuous testing programme. The self-isolation regulations came into force on 28 September 2020 and apply to:

Part 1

Regulation 2 - Requirements on person notified of positive test for acute respiratory syndrome coronavirus 2 (SARS-CoV-2) and close contacts of such persons

The Regulations were amended by the Health Protection (Coronavirus, Restrictions) (Self-Isolation and Associated Households) (England) Regulations 2020, which came into force on 14 December 2020. These amendments relate to the self-isolation period for people who test positive and their close contacts. The amendments reduce the isolation period for close contacts of people who test positive from 14 days to 10 days. It also changes the start date of the isolation period for positive cases and their close contacts.

  • The regulations were further amended by The Health Protection (Coronavirus, Restrictions) (Steps) (England) Regulations 2021 of 29 March 2021, which clarify the territorial application of the regulations and create new exemptions from the requirement to self-isolate or remain in self-isolation, including for participants in continuous testing programmes.
  • The Regulations were further amended by the Coronavirus (Self-Incision) (England) Regulations 2021, which came into force as follows: on 19 July 2021 for regulations 1 and 2(2)(a) (extending the exemption from the obligation to self-isolate for the purposes of posting a coronavirus test to include testing for antibodies), and on 16 August 2021 for all other provisions. The main change made by the Regulations is that the following people do not have to self-isolate if they have been in contact with someone who has tested positive for coronavirus:

(a) Anyone who has been vaccinated against coronavirus (but only if it has been more than 14 days since the vaccination was completed);

  • (b) Anyone who has taken part in a vaccine trial;
  • (c) Anyone who can provide evidence that they should not be vaccinated for clinical reasons.

The Regulations also provide that if any of these categories were in the self-incision period on 16 August, their self-incision period will end at the start of that day, with certain modifications thereafter.

The Regulations were further amended by the Health Protection (Coronavirus, Restrictions) (Self-Isolation) (England) (Amendment) (No. 3) Regulations, which came into force at 11. 55pm on 27 September 2021. The amendments:

  • Make further provision to determine the date under regulation 2B when a person who has received a full course of an approved vaccine is exempt from the obligation to self-vaccinate if someone in their household tests positive for coronavirus.
  • Allow a person who has received a dose of a different approved vaccine to be treated as having completed the course of administration of the approved vaccine for the purposes of the exemption in regulation 2B.

Ensure that a person's obligation to self-clear under regulation 2B, or as a participant in a testing scheme under regulation 2D, continues even if a P's obligation to self-clear under regulation 2A ceases to apply by regulation 2C.

Change the expiry date of the Regulations to 24 March 2022.

  • The regulations were further amended by the Health Protection (Coronavirus, Restrictions) (Self-Isolation) (England) (Amendment) (No. 4) Regulations 2021, which came into force at 4 am on 30 November 2021. These amendments were made necessary by the emergence of the Omicron variant and include the following key changes:
  • Exceptions to the autoimmunisation obligation (already vaccinated, participating in coronavirus-related research, participating in vaccine clinical trials, people who are clinically unable to be vaccinated) do not apply if an adult is in close contact with a person who tests positive for coronavirus and has suspected or confirmed Omicron variant.
  • Children who are in close contact with a person who tests positive for coronavirus and has suspected or confirmed Omicron variant must be autoimmunised.

The Regulations were further amended by The Health Protection (Coronavirus, Restrictions) (Self-Isolation) (England) (Amendment) (No. 5) Regulations 2021, which came into force on 9 December 2021 and, with the exception of R. 2(3) (a) (iii) – exemptions from the requirement to self-isolate which are clinical reasons for not vaccinating – which came into force on 18 January 2022. The amendments bring the exemptions from the requirement to self-isolate for people who have been in close contact with a person who tests positive for coronavirus (such as those who have received a coronavirus vaccination, those who are taking part in (or are taking part in) a clinical trial, and those who are unable to receive a coronavirus vaccination for clinical reasons) into line with the equivalent exemptions in the Health Protection (Coronavirus, International Travel, Employer Liability) (England) Regulations 2021.

  • If R. 2 (1) (a) (i) is applied, the notification must disclose the names of each person living in the same household as P (R. 2 (2) (b) ).
  • When R. 2 (1) (b) is applied, R must do the following:
  • Make sure that the child is isolated during the specified period specified in R.

If there is a request from a person specified in R. 2 (4), notify SOS of the address where the child stays (R. 2 (2) (c)

  • If R. 2 (1) (b) (i) is applied, R must notify SOS the name of each person living in the same household as a child (R. 2 (2) (D)).

Amendments to Regulation 2 from 29 March 2021 - Insertion of Regulations 2A to 2D

Participation in legal procedures

Regulation 3 - Period of self-isolation

        The (Coronavirus, Restrictions) (Autoimmunization) (England) (Amendment) Regulations 2022, which came into force on 27 January 2022, amends R. 2B so that the exemptions from the autoimmunization obligation for those who are in close contact with a person who has tested positive for coronavirus (i. e. those who have been vaccinated against coronavirus, those who are taking part in (or are taking part in) a clinical trial and those who are unable to be vaccinated against coronavirus) are consistent with the equivalent exemptions in the Health Protection (Coronavirus, International Travel and Operator Liability) (England) Regulations 2021.         For the purposes of R. 2(2), the self-exemption period is calculated as follows (R. 3(1):

        Amendments to Regulation 6 from 29 March 2021

        R. 3(2) - The warning period begins from the time of receiving the warning.

        Regulation 7 – requirement on employers of workers required to self-isolate

        Regulation 8 – notification by workers of requirement to self-isolate

        R. 3(3) confirms that it ends on the last day of the period for which R. 2(1)(a)(i) or (b)(i) applies for 10 days:

        • 5 days before the test for which the notice was given under R. 2(1) or - (R. 3(3)(a)(i)).

        Amendments to Regulation 8 from 29 March 2021

        R. 3(4) confirms that, where R. 2(1)(a)(ii) or (b)(ii) applies, it ends on the last day of the 14-day period.

        Regulation 9 – notification in respect of self-isolating agency workers.

        If P lives in the same household as a person (C) who has tested positive for coronavirus:

        (i) where C or R (if C is a child) refers to the person specified in R. 2(4) on the day symptoms first appeared, whichever is the later:

        (aa) the day 5 days before the test for which the R. 2(1) notification was made.

        Amendments to Regulation 9 from 29 March 2021

        (bb) if C is a child, the day that C or R reports it.

        Part 3

        Regulation 10 - Enforcement

        In any other case, the day recorded by the person specified in R. 2(4) as the last day that P had close contact with C before P received the R. 2(1) notification.

        • The Health Protection (Coronavirus, Restrictions) (Self-Isolation and Close Contact Households) (England) Regulations 2020 made certain changes to the self-isolation period for persons who test positive and their close contacts with effect from 14 December 2020.
        • Paragraphs (i) and (ii) of R. 3(3)(a), which relate to the start of the self-isolation period for adults and children who test positive, are replaced with the following:

        Paragraphs (i) and (ii): the day after the day they refer to, or, if the day referred to is more than 5 days before the day on which the test for which the notice referred to in Regulation 2(1) was given, 4 days before the day of the test;

        • R. 3(3)(b), which also relates to the start of the self-isolation period for adults and children who test positive, is amended so that the 10-day period starts from the day after the day of the test (previously the day of the test).
        • R. 3(4), which concerns the self-immunization period for adults and children who are in close contact with an individual who has tested positive, is amended to reduce this period from 14 days to 10 days.

        Note the transitional provisions of amended Regulation R. 3(2) and (3): If self-isolation (which will be deemed to have begun on the day following the start date) begins before the start date and has not yet expired at the time this Regulation comes into force (14 December 2020), the period will end on the later of:

        the 10th day of that period, or

        the start date

        • R. 3 (4) (a) (i) subparagraphs (AA) and (BB) concerning the start of the isolation period for adults and children who are close contacts of a person who tests positive are replaced by the following new subparagraphs (AA) and (BB):
        • (aa) the day after it is reported, or
        • (BB) 4 days before the date of the test, if the date of the report is more than 5 days before the date of the test on which the notification referred to in regulation 2(1) was made.

        Amendments to Regulation 10 from 29 March 2021

        R. 3(4)(a)(ii) (also for RE contacts) is amended so that the 10-day period starts from the day after the date of the test (previously the date of the test).

        Regulation 11 – Offences

        R. 3(4)(b) (also close contacts) is amended so that the 10-day period starts from the day after the date recorded as the last day that P had close contact with C before receiving the notification referred to in regulation 2(1) (previously the date of the last close contact).

        • The Health Protection (Coronavirus, Restrictions) (Steps) (England) Regulations 2021, which came into force on 29 March 2021, consequentially amend R3 to reflect new regulations 2 to 2D introduced on the same day.

        "R" and "responsible adult" means an adult who:

        Statutory time limit

        • "International Travel Rules" means 2020 health protection (colon virus, international travel) (England) rules.
        • The "isolation period" refers to a period in which a sel f-isolated worker or a sel f-isolation worker is required to be sel f-isolated.
        • "Isolation requirements" is a requirement of R. 2 or R. 4 in the international travel rules of these rules, and is related to situations in which the self is allowed to leave the specified location.

        Public interest

        The "main person" has the meaning specified in the 9th rule (1) (b).

        "Sel f-service workers" have the meaning of specified in Paragraph 9 (1).

        Totality of offending

        "Automatic services workers" refers to the workers who are subject to the wor k-excluded requirements based on paragraph 2 of the Regulations, paragraph 2 of the International Travel Regulations.

        ECHR proportionality – statutory defences
