Minister of State James Brown (TD), who is in charge of gambling regulations, announced today that the Gambling Lottery (Revised) Law will be enforced on December 1, 2020. This achieves a promise when the law is introduced.

The main purpose of the 2019 method is as follows:

Gaming and Lotteries (Amendment) Act 2019

Gaming
Article 3 redefines that it is a crime to fix Article 4 of the main law and promote gambling without securing a license or gambling permit first. (This is mainly redefined by the current law).

- The license is issued by the relevant Garder inspectors.
- Once a license issued is valid for 12 months.
- In any game, the upper limit of the bet is 10 euros, the maximum prize is 3, 000 euros (this is a renewal of 3 and 50 cents, which is the conventional 1956 upper limit for gambling at carnival and circus. )
- Regardless of whether it is a single or multiple times, any game cannot earn more than 3, 000 euros. If the same game is performed at the same time, the total prize will not exceed 3, 000 euros.
- This game can be promoted for the benefit of charity or philanthropy, or for the personal benefits of the promoter.
- There is no obligation to allocate profits between beneficiaries, prizes, or generated costs. Such a thing is left to the discretion of the promoter.
Part III of the Gaming and Lotteries Act 1956 – gaming machines
The 1956 gaming and lottery method (Gaming and Lotteries Act 1956) Division III (Amusement Arcades and Fan Fair Accepts) stipulates approved game consoles. The Minister of State is not responsible for the gaming machine permit. The only function of the Minister of State is the share of such a game machine and the prize amount.
The 2019 method has not changed in Article 12 and 13 of the 1956 Act on the authority for local governments to make a resolution to approve gambling in their administrative areas. District Court may issue a certificate to approve a license to allow gambling at the amusement arcade or fan fair if such a resolution is adopted. With this certificate, the operator may apply for a gambling license for machinery and facilities to the General Executive General.
Article 5 is amended to Article 14 of the Act, and raises the share of the approved gaming machines and the upper limit of the prize money from 3 to 5 cents and 50 cents. Each to 500 euros. These limits have not been updated since 1956.
Section 14 also makes it an offence to accept shares from players under the age of 18.
Section 6 amends section 15 of the Act to provide that a local court may impose conditions restricting opening hours when issuing a certificate for an approved gaming machine.
Section 7 inserts a new section 19A into the Act to provide that the Revenue Commissioners maintain a register of gaming licences (for gaming machines under Part 3 of the 1956 Act).
Section 8 adds a new section 26 to the Act to make it an offence to advertise a lottery without a licence or permit (this is a redefinition of existing law).
Lotteries
Section 9 inserts a new section 26A into the Act to provide for lotteries that do not require a licence or permit. These lotteries must be for charitable or philanthropic purposes, with a maximum total prize of €1, 000, a maximum ticket price of €5 and a maximum of 1, 500 tickets available for sale. These lotteries can only be booked once every three months.
Article 10 introduces a new Article 27A into the Act to regulate lotteries held in connection with certain events. If a lottery is part of a marketing promotion, for example where a person is given or buys a product and enters a draw in which a prize is won, no license or permit is required. The total prize amount cannot exceed €2, 500. If a product purchase is required, no fee may be charged to the entrant apart from its price. There is also no fee for redeeming any prize won.
Article 11 inserts a new Article 27B into the Act to regulate the purchase of lotteries (including bingo) promoted under a license. The following new conditions apply:
- A modernized licensed lottery system is provided.
- More detailed information about the applicant is required, including the intended beneficiaries of the lottery.
- The license is issued by the relevant Garder inspectors.
- Once a license issued is valid for 12 months.
- The maximum price of a ticket is €10.
- The weekly prize limit is €5. 000.
- Once the lottery prize reaches a maximum of €5, 000 in any weekly event (draw/raffle/ticket sale/bingo), it must be retained at this amount. (Lottery licensees are not specifically prevented from offering any kind of bonus not directly related to the prize amount if they so choose.)
- If the lottery is for charity/ charity purposes, Licensee can hold up to 5%of revenue to cover the generated expenses. The remaining revenue is distributed to prizes and is used for charity or charity.

Licensing is issued only by the District Court for the purpose of charity and philanthropy (eg, sports clubs and community groups). Licensing cannot be issued to promote lottery for the personal benefit of promoters.
