North Dakota's legalization revision is not voted as a legislative constitutional ammotrit in North Dakota voting on November 5, 2024.

This amendment acknowledged that the North Dakota Congress would legalize professional sports sports betting. [1]

      Background

      2018 Supreme Court ruling on sports betting

      In 2017, the Federal Supreme Court reported on Murphy V. NCAA (initially Christie V. NCAA), a trial on the legal nature of New Jersey's Public Questions 1 (2011). On May 14, 2018, the Supreme Court of the Federal Supreme Court was 7 to 2, and the Federal Government ruled that each state could not request sports betting, which overturned the federal government's ban on sports betting. If each state wants, sports betting can be legalized. [2]

      The Murphy vs. NCAA case (initially Christie vs. NCAA case) is a trial on dissident doctrine that the Federal Congress cannot order the Federal Law to the state government based on Article 10 of the United States Constitution. Ta. In this case, the issue was whether the State prohibit the approval of sports gambling, the Professional Amateur Sport Protection Law (Paspa) violating the ant i-order principle. [3]

      The United States Congress passed PASPA in 1992. The law has banned all government agencies, including states, to sponsors, operations, advertising, advertising, licensing, and/ or legal approval of amateur or professional team games. However, PASPA had a certain exception. One of the exceptions was that New Jersey could establish a sports gambling program if the plan was signed within one year after the PASPA was enacted. At that time, New Jersey refused to implement such plans, and PASPA was exempted for one year. [3]

      In 2011, New Jersey's voters approved the Congress to revise the New Jersey Constitution, which acknowledged to legalize the results of professional, universities, and amateur sporting events. [3]

      Based on this amendment, New Jersey passed the Sports Betting Act in 2012. The act provided for the regulation of sports betting at casinos and games in New Jersey and established a statewide regulatory scheme for sports betting. Four professional sports leagues (National Football League, Major League Baseball, National Basketball Association, and National Hockey League) and the National Collegiate Athletic Association (NCAA) (collectively referred to as the Leagues) filed a lawsuit in federal court seeking to block New Jersey's enforcement of the act, alleging that it violated PASPA. In response, New Jersey acknowledged that the act violated PASPA, but argued that PASPA violated anti-individualism principles and was therefore unconstitutional. [3]

      The amendment was introduced as Concurrent Resolution 3002 on January 3, 2023. The House adopted the amendment on January 12, 2023 by a vote of 49–44.
