Conversation you might have heard at Port Mohawk on Mother's Day:

Q: "What is this big yellow thing? A:" Ballard, mom ".

Q: "Why are there so many? A:" God and Ray Gillen, and maybe only Mayor McCarthy knows.

Q: "Shouldn't Mohawk Harbor and Casino be an elegant and attractive destination? A:" That's what they promised. "

Q: "So why is the yellow ballad here?

"They" -Developer Garesi Group, Casino Owner's Rush Street Gaming, Planning Committee, Mayor of Gary McCars and City Hall in general, Ray Gillen and Metroplex, county government. It should have been attractive and helped to attract tourists and repeaters. Instead, at least 180 bright yellow (that is, 15 dozens) surrounds the river casinos, reducing its appeal.

Furthermore, football players are taller than average (like Mohawk Harbor 4, 5 feet, 6 feet, 3 feet, 5 feet, not 6 feet, 3 feet, 5 feet). Many people in the Sennectadi parking lot or pedestrian passage must not be such a pedestrian.

What is a colon?

A colon is a sturdy, short, vertical post. Originally it referred to poles installed on piers or docks used for mooring ships, but now it is used to refer to poles installed to control road traffic, areas designed for safety or to prevent ramming attacks, and also to describe a theme or sense of place. Bollards come in many sizes and styles, removable or fixed, and are designed to evoke almost any era or taste. The type you choose depends on the purpose of the post and where it will be installed. For example, Reliance Foundry's website features illustrations, specifications, and prices for 143 models of bollards, including post covers in many styles and materials. And creative bollard displays on Pinterest. Bollards range from serious to heavy, artistic to whimsical. Styles and moods can be mixed on the same site or project.

      So, they need not be merely practical, but also detract from the landscape or streetscape. Reliance Foundry points out that "bollards enhance the visual quality of buildings and landscapes while providing visual and physical barriers for a safer, more controlled environment." And on the Mohawk Harbour vs Rivers Casino debate:

      When used in new construction or to complement existing architecture, bollards can create or reinforce thematic visual cues and enhance a sense of place within a neighborhood or community. [Click on the collage at the top of this view to see a sample of Reliance Foundry's bollards.]

      Despite the hundreds of styles of bollards to choose from and their coincidentally nautical history, the tall columns with their vibrant yellow caps are everywhere on the lawns, parking lots and walkways of Rivers Casino in Schenectady, becoming the most visible architectural feature that defines the casino complex's otherwise bland and anonymous exterior design.

      We deserve better (d)

      In my post Why Rush Street is cutting corners on Schenectady (June 19, 2015), I noted my disappointment with the final design of Rivers Casino, pointing out the image the applicants had created before the siting committee when they applied for a gaming license from New York State:

      The flashy digital brochure "Neil Bluhm's Companies" submitted to the New York State Gaming Commission shows that he has "developed and acquired over $50 billion in world-class destinations" and "established International Beacon to successfully attract the tourism market." And it "highlights the superior design" of the casino. Unfortunately, instead of being an "international beacon" like Fallsview Casino in Ontario, Canada, it has been dubbed Neil Bloom's "pioneering . . . urban shopping mall pioneer."

      Why did we get this disappointing second proposal? I emailed the Schenectady Planning Board and the City Engineer's Office on April 15, 2019 to ask about the yellow bollards and received no response:

      1. Did the applicant specify the color, style and size of the bollards in the site plan review?
      2. Did the board approve or prescribe such bright yellow bollards?
      3. Did staff review this choice and determine it was OK?

      That's something I can only wonder about myself. In a June 15, 2017 "Waste" post, we stated:

      Our first guess as to why Rush Street is not going hard for Schenectady is because our "leaders" have been stuck on it since the first rumors of a casino circulated early last year. According to this morning's Schenectady Gazette, there appears to be another reason. As with previous zoning changes, the normal Planning Commission process has been abolished (hijacked?

      In the case of casino license applications, the rush street gaming and the galescope had to submit detailed rendering and sketches in the proposed casino project. For example, the application form in July 2014 contained an overview sketch of the right side of the western parking lot, the largest parking lot. [Sketch full text] In the sketch submitted, there are more than 100 trees in the west parking lot. The presentation indicates that the applicant / developer / owner knew the parking lot to attract and maintain tourists and other customers. If nothing, the image would remind the planning committee and the planned staff what their goals on the prime landscape and appearance are. Unfortunately, the general public and perhaps the planning committee have never seen such detailed proposals to the Casino Association.

      I have to ask myself, "What happened to those trees?" In fact, the minutes of the committee on July 22, 2015 include a review of casino site planning, and Mary Moore Walliner, a member of the committee member (now chairman), described: I (at 5):

      [She is very highly valued for detailed planting plans, and I feel that the applicant listened to comments from the landscape and pedestrian aisle and considered it when considering the plan. I am.

      Ms. Wallinger, a representative of Shaenectadi, and a designer of major local government projects in cities and counties, is an excellent and new hig h-end residential area, a unique and new luxury residential area.         • What is the possibility of explanation?

        Some of the most imaginative people I know cannot understand or come up with an excuse for the excessive and almost exclusive use of bright yellow poles at Rivers Casino Schenectady. Moreover, I have found nothing in my reading that indicates that the poles need to be bright yellow to effectively perform their function. When I asked city engineer Chris Wallin about the requirement that the poles be yellow in some cases, he did not respond. (Of course, where no one expects to find a protected object, a bright color is reasonable to signal its presence, but this issue does not seem to justify the ubiquitous bright yellow choice at Rivers Casino in Mohawk Harbor.)

          Seneca tradition? No, not even though recent downtown projects have used them to protect cabinets. Surely city, county, civic and business leaders know that there are other bollards and similar security measures or screens that are more affordable and attractive. A short tour of downtown Schenectady is enough to prove this proposition. Below are the results of the bollards I recently toured:

        And Mohawk Harbor's first tenant, the Courtyard by Marriott Hotel, has successfully created a tasteful-looking lodging facility without a single yellow bollard to protect the building and its ancillary units.         Unfortunately, the Marriott example was out of the way in a retail office building on Harborway Drive in Gale.

        A branding tool or trademark for Rush Street Gaming? And no, the bright yellow bollards are not a design theme that ties all Rush Street Gaming properties together. The collage below (left) shows a wide-ranging Google Street Map shot of the exterior of Rivers Casino in Des Plaines, Illinois, which is similar in design in many ways to Rivers Casino in Schenectady, but without the yellow bollards. Similarly, the collage on the right is an exterior scene of the Sugar House Casino on Rush Street in Philadelphia. Similarly, the Google images we found of Rivers Casino Pittsburgh do not include the yellow pillars.

        Additionally, Rush Street Gaming and development partner Galesi Group have used non-yellow bollards and pole-less alternatives in strategic locations in and near Rivers Casino. Click on this collage:

        • A few years ago, I wrote about how Rush Street Gaming treats other casinos and potential cities better than Schenectady [see Rush Street Giveaways, Money on the Table, etc.]. So it's not surprising that you can't find the same bright yellow (or the same distinctive and unsightly) collection of poles at other Rush Street casinos.

        Year Three Begins: slots still reign at Rivers Casino

        Finally, is Bright Yellow a Galesi Group trademark or branding tool? There doesn't appear to be any internal checks on yellow poles within Galesi Group, despite a small occurrence of similar poles manufactured and owned by Galesi at Price Chopper/Golub headquarters (example). In fact, at the eastern end of Mohawk Harbor, you can find a more tasteful/modest (and less conspicuous) set of kols providing protection services for utility cabinets and similar items at Galesi's luxury waterfront condominiums (asking price $500. 000-700. 000). There are no yellow kols on site.

        Like the western side of Mohawk Harbor, the eastern side (between Harborside Drive and Erie Boulevard), located on the banks of the Mohawk River, is also served by a bicycle and pedestrian path and Schenectady County-sponsored ALCO Heritage signage. Both ends of Mohawk Harbor are located within Schenectady City, where the site plan is reviewed by the city's Planning Commission, and both ends were godfathered/brokered by Metroplex's Ray Gillen. Why did they end up with such visually different results?

        Discount cologne? Is it the literal row of yellow bollards and coke covers that have appeared in Mohawk Harbor, or the rest of Schenectady County? How many savings have been made to make up for the lack of aesthetics?

        Is it the people's choice? I understand that preferences are very subjective and that there are "leaders" who would like to force out the limited preferences of their constituents, but I believe that the majority of Schenectady area residents, if asked directly with a photo, would strongly prefer non-yellow bollards.

        Just as the mayor has not demanded financial, employment, acquisition interests, etc. in the agreement with the host community, the political snowmans who have been appointed city halls require attractive landscapes and shelters around the casino. There seemed to be no need for the developer to fulfill a specific promise that might have been exchanged in the land planning process.

        The collage on the right is an example of a promise that the Galesi Group exchanged at a land planning meeting was ignored by the developers and executives who are considering the Mohawk Harbor Project. According to the minutes of the Planning Committee on June 17, 2015, the project engineer Dan Hersverg stated: There is

        [There is an underground parking lot under the parking lot, so the landscaping options in this area are more restricted. He said that a large wreath will be installed on the island of the parking lot, and it will be concrete on site and it will be considerable size. He also suggested that a tree would be added to the site as much as possible, but he added that the place where he had a job would have more seasonal and no n-permanent options. Emphasis

          At a June 12, 2018 committee meeting, Jennifer Seponis of the Metropolitan Transportation Commission raised this issue. Jennifer reported that the City of Schenectady has "addressed the issue."

          Bicyclists already use the Arco Heritage Trail, and the Riverside Trail, which connects Freedom Bridge Road in Glenville with Erie Boulevard, now ends at River Street in the East Front Street area and continues to the Stockyards. The CDPHP Bike Share program recently installed a bike share station at Mohawk Harbor, increasing the number of bikers using the Harbor's Share Use Pass.             The owner of the lot, David Giacalone, said the BZA should have independently reviewed the variance issue before the Planning Commission spent two months designing a 30-foot sign in place of MH's 7-foot sign. He also pointed out that (1) Mohawk Harbor is requesting a shopping mall type sign, even though it is developing as a high-end residential and commercial mixed-use district. He presented a collage (below) to highlight his point. (2) A large, bright sign in close proximity to a busy and complex roadway would pose many safety issues, including (intentionally) distracting drivers and creating significant glare. (3) The applicant failed to prove that its zoning code difficulties were not "self-inflicted" because Mohawk Harbor was heavily involved in drafting the C-3 district code update two years ago, which specifically omitted the original C-3 sign restrictions for non-casino signs. These and other issues are discussed in more detail below. [Previously] BZA Update (Oct. 4, 2017): This follow-up concerns an application by Paul Forati, representing Mohawk Harbor, for a permit from the District to permit two signs at the Mohawk Harbor Way entrance to the complex. The matter will be presented to the Board of Zoning Appeals for the first time this afternoon, Oct. 4, 2017 (click to see the Monument Sign Variance Request, Pylon Sign Variance Request, and the Sign Location Map - Location and Intersection Failure). While the issues are essentially the same as those discussed below regarding the suitability of the signs for the site, I believe the Board of Zoning Appeals should carefully consider the statute and code requirements for permitting a zoning variance and not allow the Planning Commission to preempt a variance determination, which would put the BZA in a rather awkward position. Pylon Variance Proposal C-3 On behalf of Port Mohawk Paul Follati's Harbor District request for 220 Harborside Drive, located in the Waterfront District

            To permit a 265 square foot gateway sign 30 feet tall, 18 feet wide overall, with a 12 foot wide message board and a 1 foot setback;

            75 square foot signs are permitted, 10 7 feet tall, with a minimum 3 foot setback required. EDITOR'S NOTE: Schenectady Zoning Code defines a pylon sign as one with a base no wider than 5 feet and a message board no wider than 8 feet. Code § 264.

            The sign pylon application does not meet the criteria for granting a permit in any respect.

            As I stated in my August 2017 letter to the Planning Commission, the key question is whether a giant sign pylon is appropriate given the goals of the C-3 Waterfront District and the developer's claims that it is a unique, upscale residential-metropolitan district. As this updated collage suggests, a 30-foot pylon with 22 lighted tenant signs and a large LCD screen along a busy street would be far more appropriate for a shopping center or shopping plaza.             Overview First, the proposed sign is much larger than what is permitted in the non-swale C-3 zone and should be permitted for the area. In particular, the placement of large LED displays near busy intersections and complex road systems is problematic from a safety perspective (driver distraction and confusion, glare), the use of shopping centers/floodplains, and the type of pylon shopping center are counter to the developer's stated goals of upscale and the Town's zoning ordinance; they tarnish the image of the port area, reduce the quality of life for residents in the area, and make adjacent land less attractive for higher uses.

            The following is an update to the August 4, 2017 post "Another Sneaky Pylon" regarding the proposed Mohawk Harbor pylon sign (14' wide x 32' high, with LED screen on top, 12' wide x 6' high) and monument (40' wide x 10' high) on the Schenectady Planning Commission's August 16, 2017 agenda. The fourth argues that the sign is too large to be permitted in the C-3 district because it is unrelated to the casino allocation and must comply with the normal regulations of Article IX of the Zoning Code. . .

            Commission Follow-Up (August 17, 2017): Key points other than postponing decision until next month:

            As expected, the Commission appointed itself the lead authority for the SEQRA environmental review and adopted an adverse impact statement. Interested federal and state government agencies and the public can comment for the next 30 days, including on the impact of the sign on road safety and nearby residents. In addition, the Commission appropriately requested detailed renderings showing what the sign will look like, its exact location, and its orientation to the road.

            Poker strategy stumbles along the Mohawk (with updates)

            Despite what the master planner told me earlier this week, Mohawk Harbor did not reduce the size of the proposed sign, mindful of the need to seek a respective permit, which under state law must be the minimum increase necessary to meet the applicant's legitimate needs. Even more problematic is that no member of the Commission mentioned the need for a variance, nor did they remind Mohawk Harbor that only casino facility signs are exempt from the Zoning Code Article 9 limitations on sign size.

            Paul Fallati of the Galesi Group said one of the reasons for installing such a large monumental sign is to obscure the presence of STS Steel.

            • Commissioner Bradley Lewis correctly pointed out that the proposed large pylon is meant to warn drivers of the approaching development, not actually the name Mohawk Harbor.

            In response to my argument that the miSci sign on Knott Terrace is an appropriate sign signal, measuring 12 feet wide by 10 feet tall (see discussion and images below), Mr. Falati stated that traffic speeds on Erie Boulevard are much faster, so drivers would not be able to see 22 small signs on such a small structure. See "Decision on Mohawk Harbor Signs Pending" (Gazette, by Brett Samuels, August 17, 2017). Apparently he missed my argument that there is no need to have a group of tenant signs at all, and that 22 tenant signs are not very informative no matter how large the pylon is, i. e. the Crosstown Plaza pylon is 14 feet wide and 50 feet tall (cyclored in at that height), and passing traffic is certainly not well informed about the tenants.

            This morning (August 11, 2017), Chenectady Principal Planner Christine Primiano was quick to answer some questions about Mohawk Harbor's signage and process, providing some useful information. She wrote, "The signage below the (proposed tower) LED screen will be a panel with the names of businesses that will blend in with the rest of the signage. The LED displays will change messages, promotional events, and businesses within the MH complex." The displays will not advertise individual products or sales. Additionally, Primiano wrote, "The (monument sign) is meant to showcase the name of the complex and to be a visual consideration for the St. Station site, but we are already in talks to make it smaller due to size and breakdown issues." Christine also wrote:

            On August 16th, the Planning Commission will declare itself the lead authority for the SEQR review, opening a 30-day window for stakeholders (such as the Mohawk-Taupath Scenic Byway) and agencies (NYSDOT and Sch'dy BZA) to comment on the proposal.

            • On August 16th, the Planning Commission will do nothing but submit comments on the design.

            The 9/20 Planning Commission is expected to either reject the proposal or approve it conditionally. If approved, it will be subject to NYSDOT and Sch'dy BZA approval.

Mohawk Harbor is, of course, located in a C-3 Waterfront and Program I Mixed-Use District and is not subject to the 2015 Amendment exemption for casino-related signage, so all Article IX regulations regarding signs apply to the Commission's application.

            Size and Style: Given the goals of the City of Schenectady's Waterfront Mixed-Use District, how much discretion should Mohawk Harbor's owners have regarding the size and design of their freestanding street signs?

            Galesi and Buiko's desire to block the view of St. Ste. is absurd and inappropriate. That needs to be told to the Planning Commission and Board of Appeals, especially considering they are over-applying for a 40-foot wide, 10-foot tall monumental sign. To many of us, the mill-inlaid St. Ste. is at least as appealing as much of Mohawk Harbor (especially its casino neighbor, Boringly Ugly Rivers) and represents much of what is best in Schenectady's history and our hopes for the future. The Planning Commission cannot simply trust the taste or good intentions of the applicant. The Planning Commission, along with the BZA, must do its job to ensure that the scale and design of Mohawk Harbor is consistent with the goals of the C-3 District and the interests of the entire community, including the people who will soon be living in Mohawk Harbor and in the new homes across the boulevard, and the investors the City hopes to attract for the new business opportunities across from Mohawk Harbor. One final word: It is long past time for the Galesi Group and Rush Street Gaming to be allowed to rush their application with city officials and commissioners by demanding excessive deadlines. The Planning Commission and Board of Zoning Appeals should require detailed descriptions and renderings of the proposed signs, especially the pylons that would be so close to Erie Avenue, tall and topped with high-intensity LED displays that change frequently. What is important is an accurate description and depiction of the pylons' location and orientation to the streets and homes of Mohawk Harbor. These factors complicate the casino industry's gambling tax game, and increase revenue for soap operas, campaign contributions and lobbyists.
            • Last week, the Times Union reported in "Harness tracks, racinos, feel the heat from casinos" (June 18, 2017, Rick Carlin):
            • Jeff Gural, principal owner of the struggling Vernon Downs horse track and video store "Racino" in Vernon, Oneida County, said he would have been forced to close this fall if it hadn't been for the tax exemption. [Note: Mr. Gural is a major donor to Governor Cuomo.]
            • And today, the Schenectady Journal ran "Two Harness Straps Try to Declar Relief" (John Cropley, June 19, 2017), pointing out:
            • As casinos proliferate and competition in upstate New York grows, two horse racing tracks that also operate online casinos are seeking state aid.
            • The Saratoga Casino Hotel in Saratoga Springs will be able to use 4% of its net winnings for capital improvements.
            • Another measure would allow the Vernon Downs Casino Hotel in Vernon, near Utica, to retain an increased percentage of its net winnings. .

            • Whatever happens this legislative session, you can bet billionaire Neil Bloom's Rush Street Gaming stooges are already looking for ways to cut gambling and property taxes here at Schenectady's Rivers Casino in Mohawk Harbor, giving them an edge over their casino and racetrack competitors. . This is what they've always done with other casino venues, in good times and bad.

            • In its 15th week of operation, Rivers Casino at Mohawk Harbor in Schenectady set an astonishing new record in total net revenue: $2, 129, 115, its lowest slot revenue yet, and a GRR at the poker tables just under $100, 000 [$99, 503]. Below is a screenshot of his report for the week ending May 21, 2017, which was delayed due to Memorial Day weekend:

            • This week, Rivers Casino in Mohawk Harbor has been fined for gambling a minor (under 21 years old), and some commented on the media. They wondered why the gambling age of this casino was 18, like Racino and Indian casinos in the state.             • The following is a comment on the explanation of the legal situation that I left in the gazette and the estimation of the grounds:
            • It is right to be a little confused. New York's gambling is 18 years old, but the 2013 new games and the Economic Development Law have been exempted from the "destination" commercial casino approved by the law. [Click here for the text of the law] It must be 21 years old to gamble with new facilities (Senectadi, Senecafols/ Tires, Tioga, Montekero) approved by this law. This is the clause:
            • "§1332. Age of gambling 1. A person who is not allowed to purchase, consume or bet alcoholic beverages in approved casinos cannot enter the casino facility. ... "
            • The prize money of those prohibited based on the above provisions shall be confiscated and stored in the state gaming revenue fund. Those under the age of 21 can enter other places in the casino facility (restaurants, entertainment events, etc.), but cannot enter the actual "casino" room where gambling is allowed.
            • "Race tracks" and Indian reservations continue to allow children under 18 to enter. Such establishments either allow them into an under-21 area or give them a wristband indicating they are under 21, in which case no alcohol is served. Efforts by lawmakers and others to increase the racino gambling season have gone nowhere in the state legislature.
            • As with many laws that seem illogical, the 21-year-old age limit was likely a political concession to get the constitutional amendment and 2013 law passed. My guess is that existing racino locations (which do not have live table games) are being pushed hard to have this advantage over new commercial casinos. It may also have been a way to get the votes of others who were generally unlucky.
            • Many people worry that the younger people are when they participate in casino games, the more likely they are to develop a gambling problem. The mixing of alcohol and gambling is even more worrying.             • Note that the Pennsylvania Gaming Control Board has had to cover multiple times to allow underage gamblers and those on the self-gambling list to play at Sugarhouse, a Philadelphia casino on Rush Street. See the 2016 issue post for details http://tinyurl.
