- Posting Orders We receive transactions throughout the day and post them to your Dave Checking account in real time. We start with your universal balance, subtract any deductions from the balance, and make any adjustments from previous transactions. We then add available deposits and credits to your balance. - To determine your available balance, we start with your universal balance at the start of the business day, add any available credits or deposits, and subtract any outstanding card authorizations and fees. All transactions are debited or credited against orders received.
- You can check your available balance at any time on our mobile app. Please note that your available balance may not reflect all transactions that you have initiated or previously authorized. For example, your available balance may not include (1) transactions that you authorized but that we have not received, (2) Dave Card transactions for which the card authorization was removed before the transaction was settled due to a delayed settlement by the merchant, or (3) the full amount of Dave Card transactions for which the settlement amount exceeds the card authorization amount.
B. Limitations on EFTs
Statements are provided periodically via email unless your Dave Checking account is disabled. If you had transactions in your Dave Checking Account during a reporting period, you will receive a copy of your transactions each month. If you did not have any transactions in your Dave Checking Account, we will provide you with a copy of your transactions at least quarterly. You will not receive a paper statement.
The Bank does not permit you to overdraw your Dave Checking Account and will not charge you insufficient funds fees or overdraft fees. If the available balance in your Dave Checking Account is insufficient to cover a transaction that you have authorized, the Bank may refuse to process the transaction. However, there may be cases where your Dave Checking Account still has an insufficient balance. For example, if a deposit is returned or if a merchant settles a Dave Card transaction for an amount greater than the amount authorized for your card. You must immediately deposit funds to cover the negative balance. If your Dave Checking Account has a negative balance for more than 60 calendar days, the Bank may close your Dave Checking Account.
C. Your Right to Receive Information and Documentation of Your Transactions

2. Our Liability if We Fail To Stop a Preauthorized Transfer
State and federal laws and policies determine when your Dave Checking Account is considered inactive. Your Dave Checking Account is generally considered inactive if you have not accessed your Dave Checking Account, have not notified us about your Dave Checking Account, or have not expressed interest in your Dave Checking Account within the time period specified by applicable law. States have different laws regarding when an account is eligible for deletion, and we may be required to send your Dave Checking Account balance to the state of your last known address. We will make reasonable efforts to contact you, if required by applicable law, before remitting your account balance to a Dave Checking Account in the applicable state. After we release the funds to the state, we have no further liability to you for the funds, and you must file a claim with the applicable state authorities to recover the funds. You can avoid release of funds to the state by simply using the Mobile App to view your Dave Checking Account, make transactions, contact us about your Dave Checking Account, or respond to an abandoned property notice provided by us. We may also set your Dave Checking Account to inactive if you have not made any transactions for at least six months. If your account becomes inactive, we may close your account. You may reactivate your account while your account remains open by contacting us at Support@dave. com.
3. Notices of Varying Amounts
You agree to pay all fees and charges that apply to your Dave Checking Account and Dave Card. All fees will be debited from your Dave Checking Account and will be charged as long as you have a balance in your Dave Checking Account, unless prohibited by law. If at any time your balance falls below the fee assessment amount, the balance in your Dave Checking Account will be applied toward the fee assessment amount and your Dave Checking Account will have a zero balance. Fees are subject to change from time to time. We will provide you with advance notice of any changes required by law.
E. Our Liability for a Failure To Complete A Transaction

F. Your Liability for Unauthorized EFTs
This is our compensation. You may also be charged fees by ATM operators or other third parties.
*A fee applies to withdrawals at ATMs that are not part of the MoneyPass® network. You may also be charged transaction fees, including balance inquiries, by out-of-network ATM operators, even if your withdrawal is not completed. Such fees are charged to your Dave Checking Account by the ATM operator, and we have no control over such third-party fees. To avoid paying such fees, look for the MoneyPass® logo near the ATM or on the ATM screen.
You will not automatically receive a Dave Debit Card for your Dave Checking Account when you open your account; you must request one. The Dave Debit Card is a debit card that gives you access to the funds in your Dave Checking Account up to your available balance. You may not use your Dave Debit Card for online gambling, illegal transactions, or transfers prohibited by Mastercard. Your Dave Debit Card will expire on the expiration date listed on the back of your Dave Debit Card. As long as your Dave checking account is in good standing, we will send you a replacement Dave Debit Card when it nears its expiration date.
- The Dave Debit Card is the property of Evolve and must be delivered upon request. The Dave Debit Card is non-transferable and may be cancelled, revoked or revoked at any time without prior notice, except as required by law.
- Not all Dave Debit Card services or features described in this Agreement are available to all persons or in all locations. Any offer of any Dave Debit Card service or feature described in this Agreement is void where prohibited. Use of the Dave Debit Card is also subject to all applicable rules and practices of any payment network, clearinghouse or other entity involved in any transaction outside of this Agreement.
- In order to use your Dave Debit Card, you must activate your Dave Debit Card by following the instructions that accompany your Dave Debit Card. This includes setting up a personal identification number ("PIN"). Do not write down your PIN or share your PIN number with anyone else. We may ask you to provide personal information to verify your identity in order to complete the activation process. You agree to sign the back of your Dave Debit Card immediately upon receiving it.
Your Dave Debit Card is for your use only, and you may not request additional cards for others. If you give access to your Dave Debit Card to others, we will treat all transactions initiated as authorized by you, and you will be responsible for all transactions and fees incurred.
G. In Case of Errors or Questions About Your EFTs
You may use your Dave Debit Card to withdraw cash from your Dave Checking Account, up to your available balance, at any ATM or point-of-sale ("POS") device in the United States that accepts MasterCard, Visa Plus, Extra, Interlink, Maestro, Moneypass or Cirrus, using your PIN. Not all participating merchants allow cashback from POS devices.
- If you use a non-Moneypass ATM for any transaction, including balance inquiries, you may be charged a fee by the ATM operator, even if the withdrawal is not completed. This ATM fee is a third-party fee charged solely by the respective ATM operator and is not charged or controlled by us. This ATM fee will be charged to your Dave Checking Account.
- You can use your Dave Debit Card to make purchases with your PIN at any participating merchant that has a POS device that accepts MasterCard, Visa Plus, Plus, Interlink, Maestro, Moneypass, or Cirrus. You can also use your Dave Card to make purchases without a PIN at any participating merchant that accepts MasterCard Debit Cards.
- You can instruct the merchant to load a portion of your purchase onto your Dave Debit Card and then pay the remaining balance with cash or another card. This is called a "split transaction." Some merchants do not allow split transactions. If you wish to make a split transaction, you must tell the merchant the exact amount you want loaded onto your Dave Debit Card. If you do not tell the merchant that you wish to make a split transaction and your Dave Checking Account does not have sufficient funds to cover the full amount of your purchase, your Dave Debit Card may be debited.
You can make purchases at retailers without presenting your Dave Debit Card by providing your Dave Debit Card information, including transactions over the Internet or telephone. Making transactions in this manner has the same legal effect as if you had used your plastic Dave Debit Card. For security reasons, we may limit the amount or number of times you can make such transactions.
When the Dave Leading account is opened, a 1 6-digit card number, a thre e-digit card verification value ("CVV"), and a virtual card ("Dave Virtual Card") will be issued automatically. 。 Virtual dave cards are different from physical dave cards, have different card numbers and can be managed with mobile apps. When the validity of the virtual dave card expires, a Virtual Dave card for replacement is issued. The Virtual Dave Card allows you to access the fundable funding for the Dave Location Account and do cardless trading (see section IV (f)). See Section IV (F)), and if the MasterCard debit card is available, you can use it in the same way as a physical Dave debit card. VII. Other Legal Terms and Conditions
A. No Assignments
DAVE debit cards are available when purchasing products and services at overseas merchants, except for restricted areas. Dave may block a specific foreign transaction. If you get funds or purchase in a currency other than US dollars, the amount deducted from the usable balance of the dave account account is converted to the US dollar by MasterCard. The exchange rate between the transaction currency used for international transaction processing and the billing currency is the exchange rate selected by MasterCard from the rates available in the foreign exchange market on the corresponding central processing day, and Mastercard itself. It may be different from the rates you receive or the valid government rate on the corresponding central processing date. The conversion rate may be different from the customer's trading date and the valid rate on the day of the Dave current deposit account.
B. Sub-Deposit Accounts / Bank Deposit Custodial Program
There is a fee for transactions outside the United States. There is no fee for other overseas transactions. Some of the merchants and ATM transactions are considered international transactions due to the applied network rules, even if the customer,/ or member stores or ATMs are in the United States, so they are foreign ATMs. A transaction fee will be added. For details, see the Section III (L) fee list. In some cases, a commission may be charged from a third party.
When you use your Dave Debit Card to purchase goods or services or to receive cash from a participating merchant, the merchant may request a pre-authorization for the transaction (a "Card Authorization"). If a merchant requests this and you have sufficient Available Funds in your Dave Checking Account, we will authorize the transaction and temporarily hold the funds in your Dave Checking Account. This temporary hold will reduce the available balance in your Dave Checking Account. The amount of this temporary hold is generally the amount of your Card Authorization; however, we may place additional, pre-determined holds on transactions at certain types of merchants. When you use your Dave Debit Card at restaurants, hotels, rental car companies, and automated gas pumps ("Pay at the Pump"), a transaction may be prepared for an amount up to $75 or more. This hold will remain in your Dave Checking Account until the merchant submits the final transaction amount to us and requests payment ("Settlement"). If the merchant does not request Settlement or requests Settlement late, it may take up to seven calendar days for the hold to be released on most transactions. For hotel transactions, it may take up to 30 days for the hold to be released. For rental car transactions, it may take up to 60 days for the hold to be released.
Please note that the timing of card authorization and settlement is controlled by the merchant. That is, the merchant can initiate settlement after the card authorization has already been released. If the reservation is released and you spend money in your Dave Checking Account before settlement, your Dave Account may be overdrawn. In addition, the card authorization amount requested by the merchant may differ from the settlement amount. Therefore, it is very important that you monitor your transactions and your Dave Account. Once a card authorization is approved, you cannot stop the Dave Debit Card transaction.
Before purchasing with a Dave debit card, please check the return policy of the member store. Both the Company and Dave are not responsible for the delivery, quality, security, security, legal or legal or other aspects of the product or service purchased by the customer using the Dave debit card. If there is a problem with the product purchased with the Dave debit card, or if there is a dispute with the member store, process it directly with the merchant. If you have the right to refund the product or services obtained using a Dave debit card for some reason, you agree to accept the credit of the Dave debit card for refunds and agree to the refund policy. Masu. The amount credited to the Dave debit card for refund may not be available for up to 5 days from the date of refund trading.
If you insert a Dave debit card incorrectly, you can "freeze" the Dave debit card or virtual debit card through a mobile app. When the Dave debit card is frozen, the card will be invalidated and unusable. You can also release freezing with a mobile app. However, if you think that the Dave debit card has been lost or stolen, even if the Dave debit card is frozen through a mobile app, please contact the Bank immediately. See Section V (F) for information about Dave debit cards and how to limit your responsibilities for unauthorized transactions.
If you need to replace the Dave Card for any reason, please contact us through the mobile app chat function between Monday and Saturday 6:00 am and 4 pm. For other times, please e-mail to the dave of support@dave. com or to 1-844-857-3283. Before reissuing the Dave Debit Card, you need to provide personal information to confirm that you are the person.
If you think that the Dave debit card has been lost or stolen, you can contact the Dave Debit Card immediately by contacting us to 1-844-857-3283. We can cancel the Dave debit card that has been invalidated for 60 calendar days or more.
Digital wallets ("Wallets") provide you with another way to shop with your Dave Card. A digital wallet is a service provided by another company (such as Apple Pay, Android Pay, or Samsung Pay) that allows you to make transactions using your Dave Card wherever Wallets are available. Wallets may not be available in all locations where Dave Cards are available, and Dave Cards may not be suitable for all functions or features of Wallets. Your use of your Dave Card on or through Wallets remains subject to all terms and conditions of this Agreement.
